These Terms of Use (“Health Pod Terms”) govern your use of our in-store health pod (“Health Pod”) owned and operated by The Dairy Farm Company, Limited trading as Mannings (“Mannings”, “we”, “us” and “our”). By using our Health Pod and associated wellness assessment and consultation services (“Service”), you acknowledge that you have read, understood, and agree to be bound by these Health Pod Terms. If you do not agree to these Health Pod Terms, you may not use the Health Pod.
1.1 The Health Pod provides a general wellness assessment based on (optional) data provided by you and measurements performed by you.
1.2 A wellness professional is available to analyze your report and provide general wellness recommendations, including but not limited to potential supplement and product suggestions.
2.1 You may use the Health Pod for personal purposes only. You must not disrupt or interfere with the normal operation of the Health Pod.
2.2 The Health Pod is not intended for medical diagnosis, advice or treatment, medical service or as a medical device. The information generated by the Health Pod is intended as an information service and a general guide and may not cover any or all matters relating to your particular situation. In providing the Health Pod services, Mannings is not practicing, administering or maintaining a practice as a clinic or medical professional. Any supplement and recommendations are merely recommendation only, all of which are not in any way intended to prevent, diagnose, treat or cure any illness. You are free to decide whether to purchase any supplement or other products or services at our store (including Mannings online store) after conducting our survey.
2.3 You use the Health Pod at your own risk. If in doubt, please consult a qualified medical and/or healthcare professional with any questions regarding a medical or health condition. Do not ignore or delay seeking medical advice because of information you have read as part of the Health Pod.
2.4 You must be at least 12 years old to use the Health Pod. By using the Health Pod and its related Service, you warrant and represent that you are at least 12 years old.
2.5 Minors aged 12 to 17 must obtain parental or guardian consent before proceeding to use the Health Pod.
2.6 You should not use the Health Pod if you have a pacemaker, implantable cardioverter-defibrillator, or other implantable medical device. If you have any concerns about your health or medical condition, please consult a healthcare professional before using the Health Pod.
3.1 You agree that the wellness analysis report generated by the Health Pod (“Report”) may be shared with Mannings wellness professionals as part of the Service. Mannings may provide suggestions on products available to you in response to content generated by the Health Pod. However, Mannings disclaims any responsibility or liability with respect to any such suggestions, and you acknowledge and agree that you are solely responsible for acting on such suggestions. To the extent permitted by law, you agree to indemnify, defend and hold harmless Mannings its parent companies, subsidiaries, affiliated companies, licensors, directors, employees, agent and any third-party information providers for any liability arising as a result of your actions based on suggestions generated by the Health Pod and the Service.
3.2 You are free to decide whether to purchase any supplement or other products or services at our store (including Mannings online store) after conducting our assessment and using our Service. Supplements recommended by our wellness professionals via the Service are provided in accordance to the Pharmacy and Poisons Ordinance (Cap 138), Chinese Medicine Ordinance (Cap 549) and other applicable laws. For product details and recommendations, please refer to our in-store pharmacy or the relevant member of our staff. The use of supplements is not intended to replace a healthy and balanced diet. The supplements are only intended to complement, and not substitute for, a nutritious diet.
4.1 You agree to provide accurate and complete information when using the Health Pod and consulting our Service.
4.2 You understand that the accuracy of the assessment depends on the accuracy of the information you provide. We strive to provide accurate estimated indicators, but we do not guarantee and hereby disclaim responsibility and liability for the accuracy, reliability, availability, security, completeness, or correct usage of the indicators, information and all other data or results that you may acquire through our Health Pod and Service.
4.3 You are responsible for any decision you make based on the information provided by the Health Pod or the Service.
5.1. By using the Health Pod, you agree to be bound by the prevailing version of the Health Pod Privacy Policy and our general Privacy Policy and you consent to our collection, use and disclose of your health data, including but not limited to, your weight, body fat percentage, blood pressure, skin condition, dental condition, and other health metrics.
6.1 All content, software and technology related to the Health Pod and Service and other intellectual property rights in all material and information of and generated by the Health Pod belongs to or is licensed to us.
6.2 You may not reproduce, modify or distribute any part of the Health Pod or Service.
7.1 Mannings provide no express or implied warranties and make no representations regarding the accuracy or reliability of the Health Pod’s assessments or recommendations.
7.2 Mannings shall not be liable for any damages, including but not limited to, incidental, consequential, or punitive damages, arising from your use of the Health Pod.
7.3 All information provided is for reference only and is not intended as a substitute for professional medical care or advice.
8.1 Mannings reserves the right to modify or update these Health Pod Terms at any time without notice.
8.2 Your continued use of the Health Pod after the effective date of any changes to these Health Pod Terms shall constitute your acceptance of the revised Health Pod Terms.
9.1 These Health Pod Terms are written in English. If there are discrepancies between the English and Chinese versions, the English version shall prevail.
